On January 17th, 2022, Sonnet Swire of CNN published a story pushing a bureaucratic and partisan narrative of outrage and concern at an administration official actually understanding and questioning legally-questionable census methodology. Ms. Swire states that “Cogley did not immediately respond to CNN’s request for comment.” In fact, I never received any request from CNN to comment.

September 4th, 2021—WLW (ABC News Radio affiliate in Cincinnati, OH)—Interview with Ken Broo concerning the withdrawal from Afghanistan, Biden’s poll numbers, the Democrats’ slim majority in the Congress, inflation concerns, and serving the USA during the Trump administration 


On August 21st, 2021, Emily Bazelon and Michael Wines published a very inaccurate and dishonest article in the New York Times which appears to be an attempt to make entrenched and unaccountable senior bureaucrats look good and anyone who challenges them look bad. The inaccuracies in the article are numerous. The authors also claim that “Mr. Cogley did not respond to calls, texts and emails asking for comment.” In fact, I did not receive any calls, texts, or emails from the authors. This article is more fake news from the New York Times.

“Hi Tierney, Thanks for your inquiry.  Unfortunately, I am not ready to make any public comments. I was honored to have the opportunity to serve the USA, and in return have been treated to two rounds of false media smears.  To the contrary, I served with great integrity and offered good analysis and exceptional foresight.  I always argued for a more legal, accurate, and transparent census. As a professor, I will need to take some time to reflect on the best way to get my side of the story out.  I naturally do not trust the same media that has tried to damage my reputation as a trustworthy vehicle for those efforts.  I also need to get clarity on what I can and can’t discuss, given my legal obligations going forward concerning classified information.  I am not like the “anonymous sources” at the census bureau who violate their security clearances by leaking distorted and misleading information to a partisan press. I wish you well and will certainly read your article with interest. Sincerely, Nathaniel”

“Dear Mr. Cogley, I’m a reporter for The Associated Press, covering the 2020 census. I’m writing a story about a conference call that took place last July regarding an effort to polish your public profile after you had been appointed a deputy director of the Census Bureau. Besides you, also on the call were [XX], [XX] and [XX]. I wanted to ask you: 1. Late July was a very busy time for the 2020 census (start of NFRU after delays cause by the pandemic and the start of conversations about ending field operations early), why was this effort to polish your public profile so important that you involved the [XX] and the [XX] for the Commerce Department? The conversation focused on your remarks on count imputation that apparently had leaked to career Census Bureau workers, and that apparently had leaked to the Washington Post. 2. Who initiated this call? You? The Commerce Department? Or the White House? 3. A proposal was made for you to write, along with director Dillingham, a blog post affirming the bureau’s commitment to counting everyone. Was that blog post written? If not, why not? 4. Do you believe you were unfairly targeted by opponents, either career Census Bureau employees, lawmakers or others? My story is running later this week. I’d be grateful if you could get back to me before then. Thank you, Mike Schneider Associated Press”

Response to Michael Schneider of The Associated Press, May 25th, 2021:
“Dear Mike,   1. I was never involved in a call where the discussion was “an effort to polish my public profile” because of “remarks on count imputation.”  If you publish that, it will be more inaccurate reporting from you concerning me and my time at the Commerce Department and the Census Bureau.  Maybe you don’t mean to publish inaccurate information about me.  Maybe someone who is very dishonest and partisan is feeding you distorted and inaccurate information about me and you genuinely believe them, but it is certainly not pleasant having the Associated Press spread false stories about me again and again.  Maybe you don’t care that your (inaccurate) reporting damages me and my reputation and my family.  It certainly bothers me and I wish it would stop.  I never made any inappropriate comments about count imputation that needed to be polished over.  I have studied that topic very well and am free to make accurate comments on it, both before and now.  More people should know about count imputation, how it works, and discuss/debate it in an informed and intelligent manner.  If you would like to read some detailed and logical arguments against count imputation, I suggest you read Justice Thomas’ (Justice Kennedy joining) opinion and Justice O’Conner’s opinion in Utah v. Evans.  They detail their arguments for why they believe count imputation is illegal, unconstitutional, prone to manipulation, and will result in an ever-evolving expansion of new forms of imputations, also prone to manipulation. 2. Again, there was no call on that topic. 3. There was never agreement on the wording for any blog post. 4. I have most definitely been unfairly targeted by partisan individuals in the government, press, and activist organizations.  I wish it would stop.  Apparently, you are planning to keep it up even though I am no longer serving in the government.  I wish you would reconsider and think of the unnecessary harm your reporting causes. Nathaniel, Thank you for getting back to me. If you would humor me with some follow-up questions … What were your concerns with the use of imputation? In your opinion, what is wrong with how it’s being utilized in the 2020 census? Are you concerned about the use of imputation in general, or specific to group quarters? During your tenure at the Census Bureau, how did you make your concerns about imputation known? Did you do anything to try to stop it from being used? Do you expect the use of imputation – particularly with group quarters – to be challenged once the redistricting numbers are released? Many thanks. Mike Schneider Associated Press

Mike, Concerning count imputation, I agree with Justice Thomas’ thoughtful and constitutionally-based opinion in Utah v. Evans. I share the concerns that he articulated two decades ago. I have been vilified by a partisan press because of it. I have no further comments on count imputation at this time. —Nathaniel

Mike Schneider of the Associated Press did not quote any of this in his article released on May 30th, 2021 and instead quoted me late in the article from an illegally recorded phone conversation that was illegally leaked to him, in which I made very reasonable and principled comments, as I did throughout my time working at the U.S. Census Bureau.
